{"id":2501,"date":"2022-05-05T03:02:42","date_gmt":"2022-05-05T03:02:42","guid":{"rendered":"https:\/\/royabhishek.in\/urbanbuyer\/5-ways-buying-property-in-super-is-different\/"},"modified":"2022-05-05T03:02:42","modified_gmt":"2022-05-05T03:02:42","slug":"5-ways-buying-property-in-super-is-different","status":"publish","type":"post","link":"https:\/\/royabhishek.in\/urbanbuyer\/5-ways-buying-property-in-super-is-different\/","title":{"rendered":"5 ways buying property in super is different"},"content":{"rendered":"<p> [ad_1]<br \/>\n<\/p>\n<div>\n<p><strong>Investing in property with\u00a0your super has been extremely popular over the past few years, hasn&#8217;t it?<\/strong><\/p>\n<p>And the reasons why are far more interesting than it just being a bit trendy!\u00a0<img loading=\"lazy\" decoding=\"async\" loading=\"lazy\" class=\"alignright size-medium wp-image-53762 img-responsive\" src=\"https:\/\/cdn.propertyupdate.com.au\/wp-content\/uploads\/2015\/09\/egg-saving-retirement-super-superannuation-nest-save-money-buy-house-SMSF-property-planning-300x183.jpg\" alt=\"egg-saving-retirement-super-superannuation-nest-save-money-buy-house-SMSF-property-planning\" width=\"300\" height=\"183\" srcset=\"https:\/\/cdn.propertyupdate.com.au\/wp-content\/uploads\/2015\/09\/egg-saving-retirement-super-superannuation-nest-save-money-buy-house-SMSF-property-planning-300x183.jpg 300w, https:\/\/cdn.propertyupdate.com.au\/wp-content\/uploads\/2015\/09\/egg-saving-retirement-super-superannuation-nest-save-money-buy-house-SMSF-property-planning-1132x692.jpg 1132w, https:\/\/cdn.propertyupdate.com.au\/wp-content\/uploads\/2015\/09\/egg-saving-retirement-super-superannuation-nest-save-money-buy-house-SMSF-property-planning.jpg 1160w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\"\/><\/p>\n<p>The main benefit is that super is an alternative avenue for property investing that has very little impact on personal finances or your future borrowing capacity.<\/p>\n<p>This means it&#8217;s almost like an extra property in your portfolio that you may not have been able to buy without using your superannuation to finance it!<\/p>\n<p>It really can be a win-win situation&#8230;<\/p>\n<p>But there are a number of ways that <a href=\"https:\/\/propertyupdate.com.au\/buy-property-smsf\/\" target=\"_blank\" rel=\"noopener\">buying in your super<\/a> is different from the more traditional system.<\/p>\n<p><strong>Let&#8217;s look at five of them, shall we?<\/strong><\/p>\n<h2><span id=\"1-you-must-have-a-reasonable-fund-balance\">1. You must have a reasonable fund balance<\/span><\/h2>\n<p>Just like any standard property purchase you need borrowing capacity, however, within the superannuation environment lending criteria are much stricter.<\/p>\n<p>Generally, lenders won\u2019t approve high loan-to-value ratios in excess of 80 per cent.<\/p>\n<p>So, what I mean is that in order to borrow for an investment property purchase, you will need a reasonable fund balance.<\/p>\n<p><em>At a minimum, this is generally $200,000 or approximately 40 per cent of the investment property value.<\/em><\/p>\n<p>Many younger investors may not have accumulated a big enough super balance to invest in property.<\/p>\n<h2><span id=\"2-you-will-need-a-self-managed-superannuation-fund-smsf\">2. You will need a self-managed superannuation fund (SMSF)<\/span><\/h2>\n<p>Here&#8217;s the thing&#8230;<\/p>\n<p>You&#8217;re can&#8217;t buy direct property within retail or industry superannuation funds.<\/p>\n<p>You&#8217;re also unable to purchase a property using your superannuation funds outside of an SMSF.<\/p>\n<p>So you have to set up an SMSF to invest in property and there are establishment costs of <em>approximately $3,000.<\/em><\/p>\n<p>It makes sense, then, that if your primary reason for establishing an SMSF is to invest in property you have a reasonable fund balance.<\/p>\n<h2><span id=\"3-an-appropriate-trust-structure-must-be-established\">3. An appropriate trust structure must be established<\/span><\/h2>\n<p>Another major difference is that if you have to borrow to invest in property in your SMSF, a specific holding trust is required until the loan is repaid.<\/p>\n<p>Even though your geared property investment will be contained in a specific holding trust (called a Bare Trust), the SMSF will have beneficial ownership.<\/p>\n<p>This might sound confusing but stay with me!<img loading=\"lazy\" decoding=\"async\" loading=\"lazy\" class=\"alignright size-medium wp-image-70462 img-responsive\" src=\"https:\/\/cdn.propertyupdate.com.au\/wp-content\/uploads\/2016\/07\/36140864_l2-300x218.jpg\" alt=\"gold eggs in nest from hay on table\" width=\"300\" height=\"218\" srcset=\"https:\/\/cdn.propertyupdate.com.au\/wp-content\/uploads\/2016\/07\/36140864_l2-300x218.jpg 300w, https:\/\/cdn.propertyupdate.com.au\/wp-content\/uploads\/2016\/07\/36140864_l2-768x558.jpg 768w, https:\/\/cdn.propertyupdate.com.au\/wp-content\/uploads\/2016\/07\/36140864_l2-1024x744.jpg 1024w, https:\/\/cdn.propertyupdate.com.au\/wp-content\/uploads\/2016\/07\/36140864_l2-1160x842.jpg 1160w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\"\/><\/p>\n<p>This means that your SMSF will be credited with income and capital growth from the investment, while the trust has legal ownership.<\/p>\n<p><strong>Legal ownership can be transferred to the SMSF once the asset is fully repaid.\u00a0<\/strong><\/p>\n<p>This structure is in place to protect other investments held in your SMSF.<\/p>\n<p>But please, please listen to me on this next point&#8230;<\/p>\n<p>You as the trustee are <em>unable to sign any contracts<\/em> to purchase the property until the trust deeds have been properly executed.<\/p>\n<p>You&#8217;re probably thinking, but what does that mean?<\/p>\n<p>Unfortunately, I&#8217;ve seen too many investors caught out by signing a <span class=\"glossaryLink\" aria-describedby=\"tt\" data-cmtooltip=\"&lt;div class=glossaryItemTitle&gt;Contract of Sale&lt;\/div&gt;&lt;div class=glossaryItemBody&gt;A contract is a legal agreement - an understanding between two or more people.The Contract of Sale of Real Estate is the legal document that sets out the terms and conditions of the purchase of a property, usually put together by the conveyancer, solicitor or real estate agent \u00a0and sets out(...)&lt;\/div&gt;\" data-gt-translate-attributes=\"[{\" attribute=\"\">Contract of Sale<\/span> in the wrong entity names.<\/p>\n<p>And that makes the whole process longer and more complicated \u2013 not to mention costly.<\/p>\n<h2><span id=\"4-source-an-appropriate-smsf-lender\">4. Source an appropriate SMSF lender<img loading=\"lazy\" decoding=\"async\" loading=\"lazy\" class=\"alignright size-medium wp-image-51325 img-responsive\" src=\"https:\/\/cdn.propertyupdate.com.au\/wp-content\/uploads\/2015\/08\/farm-seed-soil-grow-wealth-money-coin-300x214.jpg\" alt=\"farm seed soil grow wealth\" width=\"300\" height=\"214\" srcset=\"https:\/\/cdn.propertyupdate.com.au\/wp-content\/uploads\/2015\/08\/farm-seed-soil-grow-wealth-money-coin-300x214.jpg 300w, https:\/\/cdn.propertyupdate.com.au\/wp-content\/uploads\/2015\/08\/farm-seed-soil-grow-wealth-money-coin-1024x731.jpg 1024w, https:\/\/cdn.propertyupdate.com.au\/wp-content\/uploads\/2015\/08\/farm-seed-soil-grow-wealth-money-coin-1160x828.jpg 1160w, https:\/\/cdn.propertyupdate.com.au\/wp-content\/uploads\/2015\/08\/farm-seed-soil-grow-wealth-money-coin.jpg 1680w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\"\/><\/span><\/h2>\n<p>Just like standard mortgages, SMSF loans are subject to lending restrictions which will vary from lender to lender.<\/p>\n<p>Unlike standard mortgages, however, there are a limited number of lending institutions that will lend to SMSFs.<\/p>\n<p>Plus, due to the holding trust requirements, you will need a Limited Recourse Borrowing Arrangement (LRBA).<\/p>\n<p><strong>What&#8217;s an LRBA?\u00a0<\/strong><\/p>\n<p>An LRBA limits the lender&#8217;s liability to the asset within the trust and does not include any other investments within the SMSF.<\/p>\n<p>Also as a general rule lending institutions will require 10 per cent of the proposed property value to remain in the SMSF as liquidity post-transaction, which can be cash or managed funds.<\/p>\n<p>That&#8217;s why having a cash buffer within the fund to allow for loan repayments and investment expenses would be very wise indeed.<\/p>\n<h2><span id=\"5-have-an-investment-mindsetnbsp\">5. Have an investment mindset\u00a0<img loading=\"lazy\" decoding=\"async\" loading=\"lazy\" class=\"alignright size-medium wp-image-50380 img-responsive\" src=\"https:\/\/cdn.propertyupdate.com.au\/wp-content\/uploads\/2015\/08\/mind-set-rich-money-lesson-think-motivational-learn-teach-money-300x205.jpg\" alt=\"mind set rich money lesson think motivational learn teach money\" width=\"300\" height=\"205\" srcset=\"https:\/\/cdn.propertyupdate.com.au\/wp-content\/uploads\/2015\/08\/mind-set-rich-money-lesson-think-motivational-learn-teach-money-300x205.jpg 300w, https:\/\/cdn.propertyupdate.com.au\/wp-content\/uploads\/2015\/08\/mind-set-rich-money-lesson-think-motivational-learn-teach-money-1024x701.jpg 1024w, https:\/\/cdn.propertyupdate.com.au\/wp-content\/uploads\/2015\/08\/mind-set-rich-money-lesson-think-motivational-learn-teach-money-1160x794.jpg 1160w, https:\/\/cdn.propertyupdate.com.au\/wp-content\/uploads\/2015\/08\/mind-set-rich-money-lesson-think-motivational-learn-teach-money.jpg 1460w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\"\/><\/span><\/h2>\n<p>My final point is that an SMSF must satisfy the Sole Purpose Test.<\/p>\n<p>What does that mean?<\/p>\n<p>Well, it means your superannuation fund is maintained for the purpose of providing benefits to its members upon their retirement (or attainment of a certain age).<\/p>\n<p>When selecting a property, consideration of the income and capital growth potential may provide better long-term benefit to an SMSF than choosing a property based on somewhere you might like to retire, for example.<\/p>\n<h2><span id=\"the-bottom-line\">The bottom line&#8230;<\/span><\/h2>\n<p>So, as you can see, while there are many potential financial benefits to investing in property using your super, it can be more complex.<\/p>\n<p>That&#8217;s why it&#8217;s so important to access professional advice from a <a href=\"https:\/\/metropole.com.au\/wealth-advisory-service\/\" target=\"_blank\" rel=\"noopener\">qualified financial planner<\/a> before you decide to go down this route.\u00a0<img loading=\"lazy\" decoding=\"async\" loading=\"lazy\" class=\"alignright size-medium wp-image-73074 img-responsive\" investors have been led down the garden path by self-serving property spruikers and bought properties in their super when this didn\u2019t suit their financial circumstances, or when the properties were not <a href=\"https:\/\/propertyupdate.com.au\/what-makes-an-investment-grade-property\/\" target=\"_blank\" rel=\"noopener\">investment grade.<\/a><\/p>\n<p>The good news is <span class=\"glossaryLink\" aria-describedby=\"tt\" data-cmtooltip=\"&lt;div class=glossaryItemTitle&gt;ASIC&lt;\/div&gt;&lt;div class=glossaryItemBody&gt;The Australian Securities and Investment Commission (ASIC) is\u00a0Australia\u2019s corporate, markets and financial services regulator.&amp;lt;br\/&amp;gt;It is an independent federal government body that monitors the behaviours, processes and transparency of Australian financial institutions.&amp;lt;br\/&amp;gt;ASIC is required(...)&lt;\/div&gt;\" data-gt-translate-attributes=\"[{\" attribute=\"\">ASIC<\/span> is now trying hard to prevent this from happening.<\/p>\n<p>The Bottom Line\u2026<\/p>\n<p>You must understand whether buying property in an SMSF is the best strategy for you and your long-term financial hopes and dreams.<\/p>\n<p>Otherwise, it might end up looking more like a financial headache rather than a stepping stone to financial freedom.<\/p>\n<p>And no one wants that, do they?<\/p>\n<p><strong>ALSO
