any article section:<\/p>\n<\/div>\n<p><strong>With an aging population and ever decreasing <span style=\"line-height: 1.5em;\">government resources, Australians are looking at being less reliant on the social security safety net and planning personal strategies to give themselves comfortable financial security in later years.<\/span><\/strong><\/p>\n<p><span style=\"line-height: 1.5em;\"> Given the vagaries of the stock market, investing in property is being recognised as a less risky way of owning a tangible investment that accrues in value over the long-term.<\/span><\/p>\n<p>As with any investment, the question is, which structure do you use to accumulate and manage your wealth?<\/p>\n<h2><span id=\"independence-starts-with-an-smsf\">Independence starts with an SMSF<\/span><\/h2>\n<p>Investing in specific property using superannuation requires you to have control of your funds via a self-managed superannuation fund (SMSF) and not a retail or industry fund.<img loading=\"lazy\" decoding=\"async\" loading=\"lazy\" class=\"alignright size-medium wp-image-10652 img-responsive\" src=\"https:\/\/cdn.propertyupdate.com.au\/wp-content\/uploads\/2012\/08\/super1-300x180.jpg\" alt=\"super\" width=\"300\" height=\"180\" srcset=\"https:\/\/cdn.propertyupdate.com.au\/wp-content\/uploads\/2012\/08\/super1-300x180.jpg 300w, https:\/\/cdn.propertyupdate.com.au\/wp-content\/uploads\/2012\/08\/super1.jpg 420w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\"\/><\/p>\n<p>There are some basic requirements in setting up an SMSF such as having a maximum of four members who are individual trustees or directors of a nominated company.<\/p>\n<p>Compliance with the <i>Superannuation Industry (Supervision) Act <\/i>(SIS Act) and appropriate taxation law is also critical.<\/p>\n<p>Establishing and managing a compliant SMSF may appear daunting but this isn\u2019t the case if you follow some basic rules.<\/p>\n<p>Importantly a property purchased using debt can\u2019t be held within the SMSF but outside in a holding trust whereby the SMSF still has full benefits notwithstanding this additional structure.<\/p>\n<p>There are also some regular costs associated with having an SMSF, so these need to be weighed up against the benefits and viewed as part of the overall investment.<\/p>\n<h2><span id=\"taxation\">Taxation<\/span><\/h2>\n<p>For some people marginal tax can be as high as 49 per cent.<\/p>\n<p>Conversely, the tax on superannuation earnings is only 15 per cent, while on capital gains it\u2019s 10 per cent when in accumulation, dropping to zero when in pension stage.<\/p>\n<p><strong>There are two types of superannuation contributions, being concessional (pre-tax) and non-concessional (after-tax money).<\/strong><\/p>\n<p>There are allowable caps for each and each type\u00a0is an aggregation of monies from any source.<\/p>\n<p>The current superannuation guarantee requirement to put 9.5 per cent\u00a0 <\/p>\n<p>of your wages into super (increasing to 12 per cent by June 2021) forms part of your concessional caps and is a healthy kick-start to investing in your future.<\/p>\n<p>With an SMSF each member is entitled to contribute additional concessional contributions up to an annual $30,000 cap for the 2014-15 financial year and beyond, or $35,000\u00a0for individuals who are 49 years old or older as of June 30, 2014.<\/p>\n<p>These concessional contributions are taxed at the lower superannuation rates rather than your marginal tax rate.<\/p>\n<p>You can of course contribute non-concessional after-tax funds of $180,000 per annum, or even bring forward up to $540,000, being three years of contributions into one year per member.<\/p>\n<p><strong>With an SMSF, tax is paid at the end of the year, giving you the benefit of being able to use the funds in its entirety throughout the year.<\/strong><\/p>\n<p>There are therefore no tax disadvantages to owning the property inside super versus outside super while working and in accumulation mode.<\/p>\n<h2><span id=\"property-smorgasbord\">Property smorgasbord<\/span><\/h2>\n<p>With an SMSF you can purchase any type of property including new or existing, cosmetic renovation, residential or commercial, land (not for development), and even off the plan. <img loading=\"lazy\" decoding=\"async\" loading=\"lazy\" class=\"alignright size-medium wp-image-95726 img-responsive\" src=\"https:\/\/cdn.propertyupdate.com.au\/wp-content\/uploads\/2017\/10\/smsf-300x184.jpg\" alt=\"Smsf\" width=\"300\" height=\"184\"\/><\/p>\n<p>You can also purchase your own business property and lease it to your company on commercial terms.<\/p>\n<p>There are, however, two principal restrictions: you can\u2019t purchase a residential property of another member; and, the property you purchase can\u2019t be changed to such an extent that it\u2019s no longer the same asset as what you originally purchased if using debt.<\/p>\n<p>While improvements are allowable, even if the property has debt, the improvement must be paid for using SMSF cash resources and not additional borrowings. Improvements can<\/p>\n<p>include items such as additional rooms, a granny flat, or a deck.<\/p>\n<p>However, if these are contemplated then a more appropriate finance structure may be required if there are limited funds in the SMSF.<\/p>\n<p>The cosmetic renovation is actually deemed to be repaired for the purposes of the SIS Act, although for tax they\u2019re not expensed but depreciated as normal.<\/p>\n<h2><span id=\"existing-commercial-property\">Existing commercial property<\/span><\/h2>\n<p>While you\u2019re restricted from purchasing residential property from a member or related party, you can buy a <a aria-describedby=\"tt\" href=\"https:\/\/propertyupdate.com.au\/glossary\/commercial-property\/\" class=\"glossaryLink\" data-cmtooltip=\"&lt;div class=glossaryItemTitle&gt;Commercial Property&lt;\/div&gt;&lt;div class=glossaryItemBody&gt;Commercial property\u00a0is any non-residential &lt;b&gt;property&lt;\/b&gt; used for commercial profit-making purposes.Commercial real is a term that covers industrial properties, retail properties (from the corner store to\u00a0shopping centres) offices and hotels.Commercial property\u00a0and residential real estate are(...)&lt;\/div&gt;\">commercial property<\/a> of one of these sources.<\/p>\n<p>There may be an advantage to sell an existing <a aria-describedby=\"tt\" href=\"https:\/\/propertyupdate.com.au\/glossary\/commercial-property\/\" class=\"glossaryLink\" data-cmtooltip=\"&lt;div class=glossaryItemTitle&gt;Commercial Property&lt;\/div&gt;&lt;div class=glossaryItemBody&gt;Commercial property\u00a0is any non-residential &lt;b&gt;property&lt;\/b&gt; used for commercial profit-making purposes.Commercial real is a term that covers industrial properties, retail properties (from the corner store to\u00a0shopping centres) offices and hotels.Commercial property\u00a0and residential real estate are(...)&lt;\/div&gt;\">commercial property<\/a> into your SMSF and use any additional borrowings from the existing amount to retire non-deductible debt as the super fund will get a tax deduction for the entire loan required to purchase.<\/p>\n<p>If ownership is currently by an individual then most states have a $50 or $500 <a aria-describedby=\"tt\" href=\"https:\/\/propertyupdate.com.au\/glossary\/stamp-duty\/\" class=\"glossaryLink\" data-cmtooltip=\"&lt;div class=glossaryItemTitle&gt;Stamp Duty&lt;\/div&gt;&lt;div class=glossaryItemBody&gt;Is a &quot;one off&quot; tax on\u00a0certain transactions imposed by state and territory governments. It\u00a0can vary depending on\u00a0the state\u00a0or territory, and may\u00a0be called stamp duty, transfer duty or general duty.&lt;br\/&gt;When buying a property, the most common types of stamp duty are on transfers of land and on home(...)&lt;\/div&gt;\">stamp duty<\/a>.<\/p>\n<p><a aria-describedby=\"tt\" href=\"https:\/\/propertyupdate.com.au\/glossary\/capital-gains-tax\/\" class=\"glossaryLink\" data-cmtooltip=\"&lt;div class=glossaryItemTitle&gt;Capital Gains Tax&lt;\/div&gt;&lt;div class=glossaryItemBody&gt;&lt;strong&gt;Capital gain&lt;\/strong&gt; is an increase in the value of an asset\u00a0\u2014 such as a property\u00a0\u2014 so that it is worth more now than what you paid for it.If I bought a house for $800,000, then sold it for $1M, I earned $200,000 in capital gain, or less if there were extra costs incurred in transferring or holding(...)&lt;\/div&gt;\">Capital gains tax<\/a> would be payable on the sale, but this could be reduced by the 50 per cent general discount, 50 per cent small business concessions, retirement super contribution, and concessional contributions.<\/p>\n<h2><span id=\"financing\">Financing<\/span><\/h2>\n<p>An SMSF can borrow funds from anywhere including banks and members so long as any loans are formalised and at commercial terms and conditions.<\/p>\n<p><strong>This is particularly critical if the loan comes from a member or related party, as non-commercial terms will lead to penalties from the ATO.<img loading=\"lazy\" decoding=\"async\" loading=\"lazy\" class=\"alignright size-medium wp-image-132155 img-responsive\" src=\"https:\/\/cdn.propertyupdate.com.au\/wp-content\/uploads\/2019\/04\/cash-money-300x193.jpg\" alt=\"Cash Money\" width=\"300\" height=\"193\" srcset=\"https:\/\/cdn.propertyupdate.com.au\/wp-content\/uploads\/2019\/04\/cash-money-300x193.jpg 300w, https:\/\/cdn.propertyupdate.com.au\/wp-content\/uploads\/2019\/04\/cash-money-1076x692.jpg 1076w, https:\/\/cdn.propertyupdate.com.au\/wp-content\/uploads\/2019\/04\/cash-money-1160x746.jpg 1160w, https:\/\/cdn.propertyupdate.com.au\/wp-content\/uploads\/2019\/04\/cash-money.jpg 2000w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\"\/><\/strong><\/p>\n<p>All loans must be under a limited recourse borrowing arrangement, so loans to an SMSF tend to be slightly more expensive notwithstanding banks require in many instances further guarantees external to the SMSF.<\/p>\n<p>In the scheme of things, the tax benefits would normally far outweigh these additional costs.<\/p>\n<p>Loan-to-<a aria-describedby=\"tt\" href=\"https:\/\/propertyupdate.com.au\/glossary\/valuation\/\" class=\"glossaryLink\" data-cmtooltip=\"&lt;div class=glossaryItemTitle&gt;Valuation&lt;\/div&gt;&lt;div class=glossaryItemBody&gt;A property valuation is when a qualified valuer assesses certain aspects of a property to determine its &quot;value&quot; - the price is it likley to sell for.This is different to a market appraisal from an estate agent.A property valuation is generally conducted on a request by you, or a lending(...)&lt;\/div&gt;\">valuation<\/a> ratios (LVR) are not normally over 80 per cent.<\/p>\n<p>This means the SMSF must have the deposit (20 per cent at least) plus costs (<a aria-describedby=\"tt\" href=\"https:\/\/propertyupdate.com.au\/glossary\/stamp-duty\/\" class=\"glossaryLink\" data-cmtooltip=\"&lt;div class=glossaryItemTitle&gt;Stamp Duty&lt;\/div&gt;&lt;div class=glossaryItemBody&gt;Is a &quot;one off&quot; tax on\u00a0certain transactions imposed by state and territory governments. It\u00a0can vary depending on\u00a0the state\u00a0or territory, and may\u00a0be called stamp duty, transfer duty or general duty.&lt;br\/&gt;When buying a property, the most common types of stamp duty are on transfers of land and on home(...)&lt;\/div&gt;\">stamp duty<\/a>, legal fees, borrowing expenses, and so on) as internal funds.<\/p>\n<p>However, the SMSF can borrow to pay for all other property costs including purchase and costs for repairs and maintenance.<\/p>\n<p>The total value of initial borrowings from all sources can later be refinanced from any other lender, but to no more than what was initially borrowed.
